Terms and Conditions

• Customer / you — any natural person aged 18 or over, or legal entity, who places an order on the Site.
• Consumer — a Customer who is a natural person acting for purposes outside their trade, business or profession, as defined by Romanian consumer protection law (OUG 34/2014, Law 296/2004).
• Order — the electronic document generated when you complete the checkout process, by which you request the purchase of Products.
• Products — matcha tea, accessories, gift sets and subscriptions presented on the Site.
• Contract — the distance contract concluded between 88th Night and the Customer, formed when we confirm the Order as described below.

You can order as a guest or create an account. You are responsible for keeping your login credentials confidential and for all activity carried out through your account. Please tell us immediately at contact@88thnight.com if you suspect unauthorised use.

We may suspend or close accounts used in breach of these Terms, for fraudulent activity, or for abusive conduct towards our team.

We take care to describe our Products accurately. Photographs are illustrative: the colour of matcha and the appearance of packaging can vary slightly between harvests and screens. Weights are net weights at the time of packing.

All prices displayed on the Site include Romanian VAT at the rate in force. Prices can be displayed in several currencies for your convenience; the amount charged is the one shown at checkout in the currency you selected. Delivery costs are shown separately at checkout before you confirm the Order.

We may change prices at any time. Changes do not affect Orders that have already been confirmed. In the event of an obvious pricing error we will contact you before dispatch and you may cancel the Order free of charge.

1. Add Products to your bag and go to checkout.
2. Enter your delivery and billing details, choose a delivery method and review the summary.
3. Accept these Terms and confirm the Order by completing payment.

After payment you will receive an automatic e-mail acknowledging receipt of the Order. The Contract is concluded when we send you the order confirmation e-mail. We may refuse or cancel an Order — with a full refund — where a Product is unavailable, where the Order looks fraudulent, or where the delivery address cannot be served by our couriers.

Orders are processed on business days. Please make sure your contact details are correct: we use them to inform you about delivery and cannot be held responsible for failed deliveries caused by incorrect or incomplete information.

Payments are processed securely by Stripe (Stripe Payments Europe, Ltd.). We accept the card types and payment methods shown at checkout. 88th Night never stores your full card details. By submitting payment you confirm that you are authorised to use the payment method.

A tax invoice is issued electronically for every Order and sent to the e-mail address you provided; it is also available in your account.

We deliver in Romania through Sameday (courier to your address or to an Easybox locker) and FedEx, and to other European countries through FedEx. The available delivery methods, costs and estimated delivery times for your address are calculated and shown at checkout. Delivery in Romania is free for Orders above the threshold displayed on the Site.

Orders placed on business days are usually handed to the courier within 1–2 business days. Estimated delivery times are indicative and start from the moment the parcel is handed to the courier. For deliveries outside Romania, any customs duties or import taxes are, unless stated otherwise at checkout, included in the price you pay (DDP).

Please inspect the parcel on delivery. If the packaging is visibly damaged, note this with the courier and contact us within 48 hours with photographs so that we can arrange a replacement.

A subscription delivers your chosen Products at the cadence you select (for example every 2 or 4 weeks). By starting a subscription you authorise us, through Stripe, to charge your payment method automatically at each renewal at the price shown when you subscribed, until you cancel.

You can pause, change or cancel your subscription at any time from your account or by e-mail. Changes take effect from the next renewal that has not yet been charged. Renewals already charged are delivered as normal and are subject to the right of withdrawal described below.

If you are a Consumer, you have the right to withdraw from the Contract within 14 calendar days from the day you (or a person you designate) receive the Products, without giving any reason, in accordance with OUG 34/2014.

To exercise this right, send us an unequivocal statement (e-mail to contact@88thnight.com is sufficient) before the 14-day period expires. Return the Products within 14 days of your notice, in their original, sealed packaging. The direct cost of returning the Products is borne by you unless the return is due to our error or a defective Product.

Exception for food products: in line with art. 16 (d) and (e) of OUG 34/2014, matcha whose sealed packaging has been opened after delivery cannot be returned for hygiene and food-safety reasons.

We refund all sums received from you, including standard delivery costs, within 14 days of being informed of your decision, using the same payment method, and may withhold the refund until we receive the Products or proof that you have sent them.

Our Products must comply with the description on the Site and with applicable food-safety legislation. Each package carries a best-before date; please store matcha sealed, away from light, heat and humidity.

If a Product is damaged, incorrect or does not conform, contact us within 48 hours of delivery with your order number and photographs. We will replace the Product or refund it, at your choice, in accordance with the legal warranty of conformity (OUG 140/2021).

Discount codes are valid only for the period, Products and conditions communicated with the code, cannot be combined unless stated otherwise, and have no cash value. We may withdraw a code at any time before an Order is confirmed.

Product reviews published on the Site are written by customers who hold an 88th Night account. By submitting a review you grant us a non-exclusive, royalty-free licence to publish it on the Site and in our communications, and you confirm it reflects your genuine experience. We moderate reviews for abusive or irrelevant content but do not edit their substance.

The Site and all its content — the 88th Night name, the 88夜 mark, logos, texts, photographs, videos, illustrations, packaging design and software — are the property of SC 88TH NIGHT SRL or of its licensors and are protected by Romanian and EU intellectual-property law.

We do our best to keep the Site available and accurate but cannot guarantee uninterrupted access. To the extent permitted by law, 88th Night is not liable for indirect losses, loss of profit or damage resulting from the use of the Site or from events outside our reasonable control (including courier delays, strikes or extreme weather). Nothing in these Terms limits your statutory rights as a Consumer.

These Terms are governed by Romanian law. Any dispute will be submitted to the competent Romanian courts, without prejudice to the Consumer’s right to bring proceedings in the courts of their place of residence.

Consumers may also use alternative dispute resolution through the Romanian consumer authority ANPC — Direcția de Soluționare Alternativă a Litigiilor (SAL): anpc.ro/ce-este-sal. The European Online Dispute Resolution platform was discontinued on 20 July 2025 and is no longer available.
